The Joint Divorce Process

1. Complete the form

The questions on the online form will help our family lawyers understand your situation. You must provide a valid e-mail address for your spouse so we can invite them to participate and allow the lawyer to contact them. Inform your spouse that an email will be sent and suggest checking their junk mail folder. The service fee includes:

  • Swearing in by a paralegal
  • Legal stamp ($115 non-taxable)
  • Online filing of your divorce documents

2. Your ex-spouse must complete the form

Your ex-spouse must respond to the invitation by filling in a form similar to the one you filled in. This will enable us to validate his or her information and confirm his or her interest in participating.

Once he or she has completed this step, we will assign a lawyer to you within 3 working days. The lawyer will then contact you to schedule a meeting according to your respective availabilities.

You will also receive a 2nd form to complete. This is for additional information. Completion of this form does not prevent us from assigning you a lawyer.

3. Meet the lawyer by videoconference

All our services are provided exclusively online. Meetings will be held by videoconference. Please make sure your camera and microphone are working before the scheduled meeting. If one is not working, you can connect by telephone.

Following your meetings with the lawyer, he or she will draw up the divorce proceedings. You will then be contacted by a paralegal, who will take your oath and have you sign the documents electronically. She will then file your legal documents online. You’ll also receive everything by e-mail.

It’s important to note that for couples whose marriage was not celebrated in Quebec, the courthouse generally requires the original marriage certificate. This may mean you have to file it yourself.

In the event of an incomplete file, we cannot represent you in court, but you can contact your lawyer for more information.

Can I Apply for a Joint Divorce?

Eligibility for a joint application to divorce includes mutual agreement on all aspects such as child custody, spousal support, and property division. You must also meet one of these conditions:

  • Living Apart for One Year: You and your spouse have been separated for at least a year.
  • Adultery: One spouse has committed adultery.
  • Cruelty: One spouse has treated the other with mental or physical cruelty.

You may need to provide the original marriage certificate and complete required online forms. Legalhood offers free family mediation hours if there are disagreements. Our family lawyers and mediators provide expert advice and support, ensuring accurate preparation of legal documents. Legalhood’s online platform makes the joint divorce process smooth, cost-effective, and hassle-free.

What Elements Are Considered During a Divorce?

The preparation of a complete separation agreement along the joint divorce includes a wide range of elements:

  • Division of Property, Assets and Debts: Divorce involves dividing marital property, assets, and debts. Legalhood’s family lawyers ensure fair property division, respecting both parties’ rights.
  • Child Custody and Child Support: Determining child custody and support is crucial. Our lawyers work to create arrangements that prioritize the best interests of the children.
  • Spouse Support: Spousal support may be necessary for financial stability post-divorce. Legalhood’s lawyers help determine fair support arrangements based on marriage duration and financial situations.

What are Other Types of Divorce in Quebec and Ontario?

  1. Contested and Uncontested Divorce: In a contested divorce, spouses disagree on aspects like custody or property division, requiring court intervention. An uncontested divorce is quicker and less costly as both parties agree on all terms.
  2. Simple Separation: A simple separation, often referred to as a legal separation, is a court-ordered arrangement where a married couple lives apart but remains legally married. During a legal separation, family lawyers can help you make decisions regarding child custody, child support, spousal support, and the division of assets, similar to a divorce.

What is Legalhood’s Return Policy?

If a client meets with a lawyer and purchased an Online Divorce and did not indicate they had children and then inform the lawyer that they do in fact have children, the client will be charged an additional $150 for the work incurred by the lawyer. If the client does not make the payment for these services, we will not complete their service. If the client asks for a reimbursement in this scenario, they will not be entitled to one.
