How does our family mediation service work?

1. Complete the Smart Form

To begin the family mediation process, clients must complete our interactive form, which consists of simple questions. You can fill out this form anywhere with a stable Internet connection.

If you have at least one dependent child: the service is free for you. The government of Quebec will pay for the first five (5) hours of mediation. After these 5 hours, you will have to pay $110/hour of mediation.

If you don’t have any dependent child: the service is also free for you. The government of Quebec will pay for the first three (3) hours of mediation. After these 3 hours, you will have to pay $110/hour of mediation.

2. An Invitation is Automatically sent to your Spouse

After completing the initial form, we will send your spouse an email inviting them to participate in mediation. If necessary, we may also contact them by phone.

PLEASE NOTE: the email you provide us for your spouse must be valid to allow us to invite them to participate.

*We recommend that you contact your spouse to let them know that they will be receiving this email as this form must be completed for us to assign a mediator to your case. They might also want to check their spam folder for the email.

3. You Provide us Additional Information by Filling out a Second Form

Once your spouse confirms their participation, confirming that both parties have agreed to participate in mediation, you will receive a second form via email.

You must provide additional details for the mediator, which is crucial for addressing specific family issues and circumstances. Please complete this form within one week of receipt to proceed with the family mediation process.

4. We Assign a Mediator to your Case

Once you both have provided all the required information, we will assign a mediator to your case within 3 business days.

The latter will then contact you to schedule your first virtual mediation session. They will also send you the link for your video conference.

Please make sure that both your camera and microphone are working beforehand. Otherwise, you may join the meeting by phone.

5. A Mediation Report is Provided to you

If you reach a settlement, the mediator will prepare a settlement report and email it to both of you.

It will then be possible, upon request, for the mediator to draft the proceedings that can either be certified by the court or homologated. The mediator will provide you with more information on this procedure.

Lastly, you will have the opportunity to have the legal procedures drawn up between your spouse and you (i.e., a joint petition for divorce, if applicable).

Legalhood is not a law firm. The lawyers and notaries who provide legal services on the various Legalhood platforms are members of the Canadian Bar Association (CBA), due to a historic and exclusive partnership concluded with the Quebec Division of this association.

Mediation facilitates legal proceedings

Joint Divorce

Joint divorce is a collaborative legal process that can be streamlined through mediation. It allows married couples, with or without children, to reach an agreement on essential matters like child custody, division of assets, visitation rights and alimony. Mediation provides a less adversarial and often more cost-effective alternative to traditional litigation, offering a safe environment for negotiation and conflict resolution. Note that mediation alone results in a non-legal agreement: couples wishing to end their union officially will have to go through the legal channels.

Child support modification or cancellation

Mediation is also a viable option for child support payments modification or cancellation issues. Whether you’re looking to adjust support amounts due to financial changes, or to cancel an existing obligation, our mediators can help you reach a satisfactory agreement. By working together, parties can reach agreements that reflect the current realities of their financial and family situation.

Homologation of the Agreement

For unmarried couples, homologation of the mediation agreement (post mediation) is an essential complementary service. This process makes the document resulting from mediation legal, ensuring that the terms of the agreement are recognized and enforceable by law. This provides additional legal certainty and ensures that the commitments made during mediation are respected by all parties.

Learn more about Legalhood's mediation service

What is mediation?

Family mediation services are designed to offer a neutral and safe environment where parties can discuss and resolve issues, even during separation and conflict. Our family mediators, accredited by the Quebec Bar, facilitate these discussions, helping clients navigate family issues constructively and respectfully.

How does our family mediation service work?

We provide mediation sessions via videoconferencing, catering to the needs of families with dependent children or busy schedules. This approach allows flexibility and reduces the need for courthouse visits, minimizing costs associated with legal proceedings. Our family mediation services are tailored to meet various family issues, including power imbalances and family violence, ensuring a fair and respectful process.

Does Legalhood really offer free family mediation?

Yes, Legalhood offers free family mediation to Quebec residents through a government-funded program. This initiative provides between 2:30 and 5 hours of free mediation, depending on the case, helping families resolve disputes without the high costs typically associated with legal proceedings. Our certified mediators guide you through the family mediation process, ensuring agreements are crafted to suit each family’s unique circumstances.

What are the advantages of mediation with a lawyer?

There are many advantages to mediation with a lawyer.

  1. Legalhood’s family lawyers have specialized training in family law and mediation, enabling them to provide sound legal advice throughout the mediation process. This expertise ensures that all agreements are legally sound and equitable.
  2. Mediation with a legal professional is often quicker and less expensive than traditional court proceedings. It promotes open communication and helps resolve disputes, including division of assets, parenting arrangements, and more, without the need for litigation.

Our lawyer mediators can help negotiate parenting plans, child support and property division, ensuring that all agreements are fair and in accordance with the law.
