Our joint divorce services require participants to meet a number of criterias:

  • Both parties must agree to participate.
  • You must agree on all aspects of the divorce. Free family mediation will be offered if this condition is not met.
  • You must fall into one of the following categories:
    • You and your spouse have been living apart for at least one year.
    • Your spouse has treated you with mental or physical cruelty that makes it impossible for you to live with him or her.
    • There has been adultery.

The Joint Divorce Process

The questions on the online form will help our family lawyers understand your situation. You must provide a valid e-mail address for your spouse so we can invite them to participate and allow the lawyer to contact them. Inform your spouse that an email will be sent and suggest checking their junk mail folder. The service fee includes:

  • Swearing in by a paralegal
  • Legal stamp ($121 non-taxable)
  • Online filing of your divorce documents

Your ex-spouse must respond to the invitation by filling in a form similar to the one you filled in. This will enable us to validate his or her information and confirm his or her interest in participating.

Once he or she has completed this step, we will assign a lawyer to you within 3 working days. The lawyer will then contact you to schedule a meeting according to your respective availabilities.

You will also receive a 2nd form to complete. This is for additional information. Completion of this form does not prevent us from assigning you a lawyer.

All our services are provided exclusively online. Meetings will be held by videoconference. Please make sure your camera and microphone are working before the scheduled meeting. If one is not working, you can connect by telephone.

Following your meetings with the lawyer, he or she will draw up the divorce proceedings. You will then be contacted by a paralegal, who will take your oath and have you sign the documents electronically. She will then file your legal documents online. You’ll also receive everything by e-mail.

It’s important to note that for couples whose marriage was not celebrated in Quebec, the courthouse generally requires the original marriage certificate. This may mean you have to file it yourself.

In the event of an incomplete file, we cannot represent you in court, but you can contact your lawyer for more information.

Eligibility for a joint application to divorce includes mutual agreement on all aspects such as child custody, spousal support, and property division. You must also meet one of these conditions:

If the client does not make the payment for these services, we will not complete their service. If the client asks for a reimbursement in this scenario, they will not be entitled to one.
