Legalhood.com is a commendable initiative for people who intend to settle their non-complex lawsuit at little cost and this fits well into the new judicial culture.
You, the plaintiff, must complete the small claims smart form application.
A claim will be automatically generated using the information you provided. An administrative and summary review will be done by our team (non-legal review).
The cost of this service is $85 plus taxes.
Remember that you are fully responsible for the content of your claim.
Our online dispute resolution services give you the opportunity to send your claim to lawyers for a legal review. We firmly believe that it is up to you to decide what type of mandate you want to give to them.
You may request one of our partner firms to:
* You understand that all legal mandates are limited in scope. The lawyer will therefore limit themselves to commenting your claim, explaining their comments and/or suggestions and ultimately, answering your questions.
You will then be asked to pay Legalhood‘s fees by credit card (Visa, MasterCard, American Express), plus applicable taxes. Court fees must also be paid. You can view the court fees for Quebec here and for Ontario, here.
Please note: you will only make one payment, but two transactions will appear on your credit card statement:
* Court fees may vary depending on the province and the value of the dispute. You will also need to accept our Terms and Conditions.
If you have chosen the WRITTEN REVIEW option, you will receive comments from the lawyer within 48 working hours.
If you have chosen the WRITTEN REVIEW + APPOINTMENT option, you will receive, within 48 working hours, the legal professional’s comments, and an email in order to make a telephone appointment with him to discuss your case. The lawyer will offer you some availabilities.
Finally, if you have chosen the WRITTEN REVIEW + APPOINTMENT AND TRIAL PREPARATION option, within 48 working hours you will receive the legal professional’s comments, as well as an email in order to make a telephone appointment with them to discuss your case. During this call (or by email thereafter), you will schedule another call, over the next three months or so, to complete the court preparation session. The latter is also done over the phone.
If you decide to select an à la carte legal service, you can review your claim and take advantage of the received comments to modify it before signing it.
When you have completed your claim, you will receive an email which will allow you to sign it electronically. This signature, which is legally valid, will appear on the court documents in the appropriate sections. Signing can be done easily on a computer, tablet, smartphone, etc.
Once signed, your legal claim will automatically be sent to the court identified by the plaintiff (i.e. by you).
* Note that Legalhood.com is not liable for errors made regarding specific courthouse locations or deadlines that may be related to the claim.
You will be able to check whether your claim has been received using the Canada Post tracking number which will be sent to you by email, either by our customer service or by Canada Post directly. Keep this proof in a safe place.
If it has been sent electronically, you will be notified as well.
Once the claim has been sent, all further instructions will come from the court itself.
Best of luck!
Legalhood is not a law firm. The lawyers and notaries who provide legal services on the various Legalhood platforms are members of the Canadian Bar Association (CBA), due to a historic and exclusive partnership concluded with the Quebec Division of this association.
