The Most Recognized Online Service in Canada

How it Works

ELIGIBILITY CONDITIONS:

  1. Your child must be of legal age and financially independent.
  2. If you do not already have a Mediation Agreement, you will be offered to go to mediation (the government of Quebec pays for up to 5 hours of mediation, depending on your specific situation). If you do not agree to go to mediation, additional costs may occur.
  3. Your ex-spouse must want to participate in this joint (and online) procedure.

The questions on the form will help the family lawyer understand your situation. You must provide us with a valid email address for your ex-spouse so that we can invite him or her to participate and so that the lawyer can contact him or her afterwards.

We recommend that you contact your ex-spouse to let him or her know that an email will be sent to him or her and that a form will need to be completed. You can also suggest that he or she check his or her junk mail folder, as emails can sometimes be found there.

It is important to note that the cost of the service includes :

  • Swearing in by a paralegal;
  • Legal stamp ($181 non-taxable);
  • Online filing of your divorce documents.

Your ex-spouse must respond to the invitation by filling in a form similar to the one you filled in. This will enable us to validate his or her information and confirm his or her interest in participating.

Once he or she has completed this step, we will assign a lawyer to you within 3 working days. The lawyer will then contact you to schedule a meeting according to your respective availabilities.

You will also receive a 2nd form to complete. This is for additional information. Completion of this form does not prevent us from assigning you a lawyer.

All our services are provided exclusively online. Meetings will then be held by videoconference. Please make sure your camera and microphone are working before your scheduled meeting. If one is not working, you can connect by telephone.

Following your meetings with the lawyer, he or she will draw up the necessary documents to cancel or modify your support payments. You will then be contacted by a paralegal, who will swear you in and have you sign the documents electronically. The paralegal will then file your proceedings with the court. You’ll also receive everything by e-mail.

Learn More about Child Support

Child support is crucial in family law, ensuring that a child’s financial needs are met following a separation or divorce. In Quebec, child support modification and cancellation are governed by strict guidelines to ensure fairness and adequacy. This support typically covers necessities such as food, clothing, education, healthcare, and extracurricular activities. The child support amount is determined by various factors, including the parents’ income and the child’s specific needs: take a look at the child support tables. The aim is to maintain the child’s standard of living close to what it would have been if the parents had remained together. Child support obligations are essential for maintaining the well-being of children in both common-law and legally married families.

Change in Income for Either Parent

A significant increase or decrease in the income of either parent can necessitate a child support modification. If a payor parent receives a substantial raise, loses their job, or experiences a significant financial shift, the child support amount may be adjusted to reflect the new financial situation. Changes in income sources, such as bonuses or other earnings, are also considered.

Change in the Child’s Needs or Expenses

As children grow, their needs and expenses can change. New educational requirements, medical expenses, or participation in extracurricular activities can lead to increased costs. If these changes are substantial, a modification of the child support agreement might be required to accommodate these new expenses. Extraordinary expenses, such as those for special needs or health issues, can also mandate changes.

Change in Custody Arrangements

Any changes in custody arrangements, such as a child spending more time with one parent than previously agreed, can affect the child support payments. If one parent assumes greater financial responsibility due to increased parenting time, the support payments may need to be adjusted to reflect this new arrangement. Shared or split custody scenarios directly influence the child support amounts.

Emancipation of the Child

When a child reaches the age of majority, becomes self-sufficient, or otherwise no longer requires financial support from their parents, child support payments can be canceled or modified accordingly. In Quebec, the age of majority is 18, but support can continue if the child is still dependent due to ongoing education or other reasons. An adult child who is a student or has special circumstances might still be entitled to support.

In Quebec, the cost of changing or canceling child support can vary depending on the complexity of the case and whether legal representation is used. Typically, if both parents agree to the changes, the process can be straightforward and less costly, often involving a simple application to the court.

However, if there is disagreement and the matter needs to be settled in court, the costs can increase significantly. These costs may include court fees, legal fees for family lawyers, and any other associated costs such as mediation or expert witness fees. It is advisable for parents to seek legal advice from a lawyer or law firm to understand the potential costs involved in their specific situation. Consulting with child support lawyers or online lawyers can provide clarity on anticipated expenses.

Child support in Quebec differs from other provinces and territories: instead of being calculated based on the federal child support guidelines, provincial child support guidelines are used which take into account the annual income of both parents, the number of dependent children, and the custody arrangements. The primary tool used is the Child Support Determination Form, which ensures that the monthly child support calculation is fair and standardized. Key factors include:

  • Parents’ Gross Income: The combined gross income of both parents is considered to determine the amount of support. This includes salaries, wages, bonuses, and any other sources of income. Respective incomes from various sources are all taken into account.
  • Number of Children: The calculation adjusts based on the number of children requiring support.
  • Custody Arrangement: The amount of time each parent spends with the child influences the support amount. Shared custody, where each parent has the child for at least 40% of the time, can lead to adjustments in the standard calculations.
  • Special Expenses: Additional expenses, such as medical costs, educational fees, and extracurricular activities, can also be factored into the final support amount. Extraordinary expenses and special needs are critical considerations in determining the child support amounts.

The Quebec government provides an online child support calculator to help parents estimate their child support payments, ensuring transparency and ease of understanding. It is essential to use accurate and current financial information when calculating child support to ensure that the needs of the child are adequately met. Understanding the child support tables and consulting with a legal professional can aid in comprehending the obligations and rights of both parents.
